This website, as well as mobile service applications, is managed and wholly (100%) owned by Mareyat Advertising Agency, located in Riyadh, Kingdom of Saudi Arabia. “Mustajarati", "we", "us", "our", collectively represents "Mustajarati Services” (hereinafter referred to as the “First Party”). “User”, is a description of the so-called “Lessor”, “Lessee”, “Service Provider” or “Service Applicant” (collectively hereinafter referred to as the “Users” or the “Second Party”).
Terms of Use, Privacy Policy, and all additional terms and conditions, if any, published on Mustajarati website and govern the use of this service provide for the protection of Mustajarati Platform and its employees and preserve the rights of users.
Please read these Terms of Use carefully and print a copy “if possible” for your reference. You shall agree thereto before using Mustajarati services.
In the event that you access our Services, register and/or continue to use or access the Services, you agree to be bound by the Terms of Use and the additional terms and conditions and policies with immediate effect.
We reserve the right to modify these Terms at any time. Your continued use of Mustajarati Services after the posting of any change constitutes acceptance of such change to Terms of Use and the amended terms and policies.
About Mustajarati
Mustajarati is the first reliable and secure online platform in Saudi Arabia that adopts the approach of empowering the sharing economy. It gives the users an investment opportunity to post their products and provide reliable rental services.
If you use our Services, you accept and agree to the following, as further set forth in these Terms:
“Mustajarati” reserves the right to make its services secure in order to maintain the privacy of its users to feel peace of mind and high reliability during their use by requesting verification of the users' identity to authenticate their accounts through mobile number, e-mail, and national identity/residency to ensure the security and quality of the service. Notwithstanding that the use of our services is at your own risk, any or all contracts entered into between the Service Provider and the Service Applicant or the Lessor and the Lessee for rental transactions through “Mustajarati” shall be entirely and exclusively between the two parties (the Service Provider and the Service Applicant), or (the Lessor and Lessee) only. You expressly accept and agree that “Mustajarati” is not a party to any contractual transaction entered into between the two parties through the Platform and shall not be liable for insuring the Users’ Products or compensating for damage, loss or steal all or part thereof. Our Platform shall not be obligated to monitor or resolve any dispute that may arise between the Users.
1. The terms and expressions contained in the Terms of Use and the additional policies and provisions, if any, shall have the meanings set out as follows:
A. Platform(s): means all websites and applications of smart devices through which our services are provided.
B. Rental items: mean products or services offered on the Platform to be rented.
C. Lessor: means user who offers for rental their products through the platform to the others.
D. Lessee: means user who wishes to rent any item offered on the platform to benefit thereof and meet their needs for a specified period.
E. Service Provider: means user who offers their services through the platform in consideration of fees to invest their professional skills or practical experience to carry out work on behalf of others.
F. Contractual Transaction: means entering into a specific electronic contract in which item or finished item for a specified period of time between the two parties “(the Lessor and the Lessee) or (the Service Provider and the Service Applicant)”. The transaction is completed by electronically paying the financial value through the platform and handing over the rental item in person by the Lessor to the Lessee. The specified service may be completed by the Service Provider in favor of the Service Applicant.
2. Registration Terms and Conditions
This is a contract between you and Mustajarati. You must read and agree to these Terms before using our services. You may use Mustajarati Service only if you can enter into a binding contract with Mustajarati.
Mustajarati reserves the right in its sole discretion to agree to, or refuse, any user to join or continue to use Mustajarati Service if it deems it appropriate in accordance with the Terms of Use.
As a user, you have the right to register on Mustajarati at any time to use it for the purpose of renting, not selling, your item, if you meet the following conditions:
2.1 Eligibility:
The User must be at least 18 (eighteen) years of age to use our services.
2.2 Legal Status:
The user must have a valid national ID/residency and reside in the Kingdom of Saudi Arabia.
2.3 Methods of Payment:
The User shall provide an electronic payment method approved on the platform to use the service, including but not limited to: Mada, Visa, MasterCard, etc.
2.4 Usage Restrictions:
Your registration in Mustajarati is exclusively for your use only. You shall be liable for contractual transactions and their impact on the parties and the content you post on your account. You shall also be personally liable for any violation of any of these Terms. In no way may you assign the account to any person or entity or use it on behalf of others unless there is a written notification signed by you sent to Mustajarati Department indicating that you grant the authorized person a permission to use your account.
2.5 Acceptance and approval:
You shall agree to the Terms of Use, Privacy Policy, and all additional terms of use, if any.
2.6 Terms of Account Verification:
The User shall meet all the following account authentication requirements:
A. A Saudi mobile number;
B. A valid Email;
C. For individuals: If required during the registration, they shall attach a copy of a valid national ID/residency for verifying the user’s identity and authenticating their account to use the platform.
D. For Companies: The Company’s owner may provide all of the above and send a copy of the commercial register. Representatives of the companies shall send the above with a copy of the commercial register as well as a letter signed by the company’s owner indicating their approval on those who represent their company to post the company’s products on their account to rent thereof. The documents required from the company's owner and their representatives shall be sent to care@mustajarati.com
3. Special Conditions for the Lessor and the Service Provider:
When you register in Mustajarati as a Lessor or Service Provider, your account will give you features and functions that help you to post and offer your products through the platform for leasing. The Platform shall never allow you to sell your products.
Before starting to use the platform, you shall represent and warrant to read and agree to these Terms of Use and terms of the Lessors and to ensure that you understand them and accurately and correctly include the required data.
These requirements are as follows:
3.1 Accepting or cancelling the contractual transaction:
Once you accept and agree to the Lessee's request to rent your product, a legally binding contract will be immediately entered into between you and the concerned Lessee to initiate the rental and the rent will be debited directly from the Lessee's account.
You represent and warrant that you use our services entirely at your own risk and that Mustajarati is not a party to this contractual transaction and shall not be liable for any disputes that may arise between the parties.
You also respond to and communicate with the Lessee to coordinate the personal delivery of the rental item during the specified rental period.
You may accept or decline any request created by the Lessee prior to commencing the contractual transaction (the rental process) at your own discretion without incurring any cancellation/rejection fee in this case.
You represent and warrant that you will pay any fees charged to you if:
A.You fail to hand over the rental item to the Lessee or hand over the finished item to the Service Applicant during the specified contractual period.
B. You cancel/reject any rental request created by the Lessee/Service Applicant that you earlier accepted and approved and then you rejected/cancelled, prior to handing over the rental item to the Lessee or delivering the work to the Service Applicant.
C. The Lessee/Service Applicant refuses to receive the rental item because it has damages or defects that were not indicated and disclosed in the description of the item’s advertisement, or it is different from the offered item whose information and pictures were viewed by the Lessee on the platform.
The fees of any or all of these above violations are Fifteen percent (15%) of the rental value.
3.2 Posting and Describing Rental Items:
When you post any rental item for rental through the Platform, you represent and warrant that the item in your account is entirely at your own risk.
You shall do the following:
A. While listing the rental item, you shall specify the main and sub-categories by field of the item, and provide complete information and an accurate description of the item. Note that if you do not comply with this requirement, Mustajarati administration will delete your advertisement.
B. You shall disclose any defect or damage, if any, or any shortcomings and limitations in the use of the rental item.
C. You shall indicate any additional necessary information such as the "method of use/installation" of the rental item and also explain any requirements that shall be met to use the item.
D. The media files (images/videos) attached to the description shall accurately and accurately reflect the condition of the rental item. Also, recent photos of the rental item shall be taken directly by a smartphone camera and periodically updated.
3.3 Pricing of the rental item:
While listing a rental item in Mustajarati, you shall specify the item price per unit time of the rental period which is entirely at your own risk. When setting a price for a rental item, its total rental price in addition to the deposit, if any, shall not exceed its current market value. The pricing of the rental item shall also include VAT in an amount of 15%, for example: (If the rental value of the item for one day is SAR 100, add 15%, the total shall be SAR 115.
3.4 Request additional funds outside the Platform:
You represent and warrant not to request any other additional funds from the Lessee outside the Platform, including but not limited to delivery or installation fees or even deposit for the rental item unless indicated and set forth on Mustajarati.
3.5 Requesting Deposit for a Rental Item:
You have the right to request a deposit for the rental item at your own discretion. The deposit shall be specified “if selected” through the platform only, to be received in cash from the Lessee in person upon delivery of the rental item. The deposit shall be fully refunded if the rental item is returned in the same condition as it was delivered.
You represent and warrant that any breach of these Terms shall be considered a violation, and you shall pay Fifteen percent (15%) of the rental value. In the event of repeated violation, you shall pay a fee of SAR 300 or your account will be cancelled and you will permanently prevented from using the platform.
3.6 Paying Dues of the Lessor/Service Provider:
Mustajarati shall transfer your financial dues of renting your products through the platform after deducting Mustajarati commission “which will be shown below”, including the value-added tax along with any other fees, if any, no later than ten (10) working days after completion of the rental period.
3.7 Prohibited Item List:
When you use Mustajarati, you represent and warrant that you will not post any such Prohibited Items (defined below), similar or related item on the Platform.
If the user violates any provision by posting any prohibited items on the platform, Mustajarati reserves the right to permanently delete the user’s account, blacklist the account and/or report the content of the prohibited items and user information to the relevant regulatory authorities.
Mustajarati also reserves the right to amend this Prohibited Item List at any time with or without reason, and remove any Rental Item listed on the Platform, whether or not it is included in this Prohibited Item List.
The Prohibited Items on the platform include:
A. Alcohol, tobacco, narcotics, and paraphernalia for the manufacture or use of tobacco or drugs.
B. Gadgets, pornography, or +18 movies.
C. Counterfeit or pirated rental items that infringe intellectual property rights such as video games, pirated movies, copied books or any other infringement of any third party proprietary rights.
D. Predatory or rare animals for which local regulations in the Kingdom of Saudi Arabia prohibit their acquisition, sale or rental.
E. Rental of all kinds of labor, such as domestic workers and others, including but not limited to: Domestic workers, drivers, female and male cooks and others.
F. Fireworks, destructive devices and explosives, including any materials that enable the manufacture of fireworks, detonators and explosive devices.
G. Army or police insignia, uniforms of any entity, and/or any government emblems, military or police related insignia and/or items that are not permitted to be sold or traded under any applicable law.
H. Weapons and related items (such as firearms, firearm parts and magazines, ammunition, tear gas, stun guns or folding knives).
I. Drones and their accessories and similar items that serve the same purpose.
J. Renting jewelry such as gold, silver and diamonds.
K. Renting books that are not permitted or are prohibited in Saudi Arabia.
L. Renting books that are not permitted or are prohibited in Saudi Arabia.
M. Renting subscriptions to sports clubs or website services such as websites that offer movies or e-books with subscriptions for a certain period.
N. Renting hair extensions and wigs.
3.8 Representations and warranties about rental items:
When you enter into a contractual transaction with a Lessee as a Lessor, you represent and warrant that:
A. You fully own the rental item or have all necessary authority to post the item on Mustajarati and lease it to the Lessee in accordance with these Terms.
B. You undertake to abide by and comply with the terms set forth in clause 3.2 “Listing Rental Items” and all terms set forth in these Terms, and warrant not to write your telephone or any other means of communication in the advertisement title or description of the rental item or on the images and other media added in the advertisement. Mustajarati administration will immediately delete your ad without any liability when you violate this clause. In the event of a repeated breach of this clause, you represent and warrant paying a fee of up to three hundred riyals (SAR 300) or your account will permanently banned from using the service.
C.Posting rental items on Mustajarati and renting them to the Lessee under these Terms does not breach any agreements you may have previously entered into with parties or third parties.
D. You comply with all applicable laws, regulations, and instructions of Saudi Arabia and other tax requirements and you will not infringe the intellectual property rights or privacy of any third party.
3.9Acceptance of Potential Risks:
When you rent your rental item to a Lessee through Mustajarati Services, you accept and agree that you are entering into a contractual transaction to conclude a legally binding agreement with the relevant Lessee - not with Mustajarati.
You represent that there may be potential direct or indirect risks resulting from renting your items to the Lessee - including but not limited to, loss or damage of your Rental items. You assume all potential risks relating to this process. You expressly agree, without limiting any other term of these Terms that Mustajarati is not a party to this contractual transaction and is not obligated to resolve disputes between the parties or provide solutions to them. Rather, it reserves the right to monitor its services to prevent violations of these Terms and misuse of the Service.
To avoid or reduce these potential risks, we strongly recommend the Lessor to request deposit for the rental item from the Lessee, provided that the total value of the rent and deposit does not exceed current market value of the rental item. The deposit shall be refunded to the Lessee when the rental item is returned free of any damages.
4. Special Conditions for the Lessee/Service Applicant:
4.1 Item Rental Request:
You can request to rent a rental item from the Lessor’s products offered on their page on Mustajarati. When the Lessor agrees to your request and confirms your reservation of their product, a legally binding agreement is directly entered into between you and the relevant Lessor to begin the contractual transaction and the rental value is immediately paid from your account.
You represent and warrant that you use our services entirely at your own risk and that Mustajarati is not a party to this contractual transaction, shall not be liable for insuring the rental item or paying a compensation for damage or loss of the item. Mustajarati is not obliged to resolve any disputes that may arise between the users.
4.2 Cancellation of Item Rental Request:
You may cancel your request to rent a rental item without any fees or liability provided that such cancellation takes place before the Lessor/Service Provider accepts and agrees to the request.
You cannot cancel the item rental request after the Lessor agrees to it and confirms its reservation, but if you want to cancel the request to rent an item after the Lessor has approved it, you represent and warrant to bear the cancellation fee in an amount of Fifteen percent of the rental value (15%).
4.3 Returning the Rental Item and Restrictions on Use:
When you start the contracting process with the Lessor, you will be allowed to use the rental item of the Lessor for a specified period.
You undertake to return the leased item to the Lessor on the agreed date upon the expiry of the lease period.
You may request an extension of the rental period at the Lessor's own discretion.If you keep the item after the end of the agreed rental period or fail to deliver it on time, you accept and agree to pay an amount for each additional hour as part of the daily rental value. This amount is calculated as follows: (Rental value divided by 24 hours equals rental value of each additional hour). For example, the rental value per day is SAR 100, so each additional hour will equal 100/24 = SAR 4.16.
4.4 Possible Damages to the Rental Item:
As a Lessee, you represent and warrant that you are liable for delivering the rental item to the Lessor immediately upon the expiry of the rental period in the same condition it was in at the time of receiving it from the Lessor.
You represent and warrant that you are fully responsible for any damage to the rental item that may occur during the specified rental period. In the event that the rental item or part of thereof is damaged, lost or stolen, you agree to compensate the owner (the Lessor) with the value of the rental item as per its current market value.
If the damage to the item is minor or partial and can be repaired, the Lessor shall be compensated with the value of the damage according to the estimation of a technician agreed upon by both parties.
4.5 Lessee's Representations and Warrants:
While requesting a reservation of a rental item through Mustajarati to begin the contracting process with the Lessor, you represent and warrant that:
A. You have read, understood and accepted the description of the rental item that the Lessor has included in their product post.
B. You currently have a sufficient amount to cover the rental value required to rent the Lessor’s item.
C. You accept and agree that you will be liable for paying any arrears incurred by you either for late delivery of the items to the Lessor or fees of violations of the Terms of Use in accordance with the terms of this Section.
D. You agree to use the rental item for your own benefit and not on behalf of third parties and you are under your full responsibility in accordance with these Terms.
4.6 Warranties of Potential Risks of Renting an Item:
When you request to lease a rental item from a Lessor through Mustajarati, you accept and agree that you are entering into a contractual transaction to conclude a legally binding agreement with the relevant Lessor - not with Mustajarati. You represent that there may be potential direct or indirect risks resulting from leasing the items offered by the Lessor on the platform - including but not limited to, loss or damage of the rental items. You assume all potential risks relating to this process. You undertake to compensate the Lessor for any damage that may be caused to their rental item, whether it is partial damage, by estimating the damage by a technician agreed upon by both parties, or compensate for the entire market value of the item if the item is lost or damaged and can’t be repaired.
You expressly agree, without limiting any other term of these Terms that Mustajarati is not a party to this contractual transaction and is not obligated to resolve disputes between the parties or provide solutions to them. Rather, it reserves the right to monitor its services to prevent violations of these Terms and misuse of the Service.
5. Fees, Terms and Methods of Payment, and Taxes:
5.1 Commission of Mustajarati:
Eighteen percent (18%) is collected from each contractual transaction entered in between the two parties as a commission for Mustajarati. This commission is deducted from the total amount of the rental/service paid by the Lessee/Service Applicant.
5.2 Commission Evasion:
You may not engage in any practice or method that reduces or evades the Commission of Mustajarati that would have been paid if the contractual transaction had been completed using Mustajarati platform. (These practices are collectively referred to as "Commission Evasion"). Commission evasion includes, but not limited to, initiating any contractual transaction on the platform and then coordinating in another way to rent or lease the rental items outside Mustajarati, setting a zero value or pricing the item at a very low amount on the platform. If any user engages in any of these commission evasions, such user(s) shall indemnify and hold Mustajarati harmless from and against any losses incurred as a result of the commission evasion. If you attempt to engage any user you met through Mustajarati to complete a rental process to avoid using Mustajarati Service, you are liable to pay a fine of up to three hundred riyals (SAR 300) as a fine, or Mustajarati will terminate your account without any liability to you.
5.3 Methods of Payment:
We, at Mustajarati, accept multiple methods of electronic payment, including but not limited to, Mada cards, Visa and MasterCard credit cards. The due rental value will be deducted directly from your account after confirming the rental request. Mustajarati will not carry out any rental transaction without obtaining permission to validate the leasing through your payment method.
5.4 Taxes:
You represent that you shall be personally liable for paying all taxes currently applicable in the Kingdom of Saudi Arabia as they become due currently or in the future when imposed as per your use of “Mustajarati” Service. The tax currently applied is the value added tax of 15%.
5.5 Electronic Payment Processing Service:
Electronic payment of rental transactions made through Mustajarati is processed by Noon Payments. You can read the full Terms and Conditions of Noon Payments through the following link: https://www.noonpayments.com/privacy-policy
Electronic payment processing services are provided to users on Mustajarati by Noon Payments. By agreeing to these Terms or continuing to use Mustajarati, you agree to be bound by Noon Terms of Use as it may be modified by Noon Payments from time to time.
So that Mustajarati be able to process the payment through Noon Payments, you agree to provide accurate and complete information about you and your items to Mustajarati, and authorize and share with Mustajarati information of transaction related to your use of the payment processing services provided by Noon Payments.
6. Indemnification and Disclaimer:
6-1 Indemnification:
You agree to indemnify and hold Mustajarati, its directors, agents, employees, officers, and affiliates harmless from and against any and all claims of compensation for damage and potential risks of the rental transaction, such as damage or loss of rental items or costs and expenses, (including but not limited to attorney’s fees) arising from the following:
A. Your use of and access to Mustajarati, including but not limited to, any data or content sent or received by you and your lease or rental of any rental item.
B. Your breach of any provision of these Terms, including but not limited to your breach of any of the above representations and warranties.
C. Your infringement of any rights of any third party, including but not limited to any intellectual property rights and privacy rights.
D. Your violation of any applicable law, regulations or instructions.
E. User's content or any content posted through your account, including but not limited to information that is misleading, false, inaccurate, or offensive to individuals, entities, religions, races, racial discrimination against sex, color and disability, or any content that violates applicable laws and regulations of the Country.
F. Willful misconduct.
G. Any third party's access to and use of Mustajarati service with your username.
6.2 DISCLAIMER:
ALTHOUGH WE ALWAYS MAKE EVERY EFFORT TO PROVIDE A SECURE SERVICE TO MAKE “MUSTAJARATI” AS FREE FROM POTENTIAL RISKS AS POSSIBLE BY ENACTING THE PRIVACY POLICIES OF USERS AND THE TERMS AND CONDITIONS OF USE OF THE PLATFORM WITH THE APPLICATION OF BEST PRACTICES AND SOFTWARE SECURITY STANDARDS TO PROTECT USERS’ DATA FROM THEFT OR EXPOSURE OF THE PLATFORM TO HACKING OR HOWEVER, THE “MUSTAJARATI” SERVICES ARE PROVIDED TO YOU “AS IS” WITHOUT WARRANTIES, REPRESENTATIONS OR REPRESENTATIONS. USE OF THE MUSTAJARATI SERVICE IS AT YOUR OWN RISK.
WE DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR COLLATERAL, INCLUDING, BUT NOT LIMITED TO, ALL CONDITIONS, REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR OR GENERAL PURPOSE, OF NON-INFRINGEMENT, OF COMPATIBILITY OR THAT THE SERVICES ARE SECURE OR ERROR FREE OR WILL OPERATE WITHOUT INTERRUPTION OR WILL BE PROVIDED IN A TIMELY OR PROPER MANNER OR AT ALL. DEFECTS OR ERRORS WILL BE CORRECTED AND OUR SERVICE WILL BE FREE OF ANY VIRUSES OTHER HARMFUL COMPONENTS.
USE OF THE PLATFORM IS AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE.
“MUSTAJARATI" DOES NOT GUARANTEE OR ENSURE ANY ITEMS THAT ARE ADVERTISED THROUGH THE PLATFORM BY USERS AND SHALL NOT BE LIABLE THAT THAT GOOD ARE VALID OR FREE OF DEFECTS, OR THAT THE DESCRIPTION PUBLISHED IN THE ADVERTISEMENT IS ACCURATE OR THE INFORMATION IS COMPREHENSIVE AND CORRECT. MUSTAJARATI SHALL NOT, IN ANY WAY, BE A PARTY TO THE CONTRACTUAL TRANSACTIONS THAT TAKE PLACE THROUGH THE PLATFORM OR SHALL MONITOR ANY TRANSACTION BETWEEN THE LESSSEE, LESSOR AND SERVICE PROVIDER.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MUSTAJARATI, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGE ARISING FROM THE USE OF, INABILITY TO USE, THIS SERVICE AS LOSS OF PROFITS, DAMAGE, LOSS OR THEFT OF PRODUCTS UNDER ANY CIRCUMSTANCES. MUSTAJARATI WILL NOT BE LIABLE FOR ANY DAMAGE, LOSS OR INJURY CAUSED BY HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS TO YOUR ACCOUNT AND THE INFORMATION CONTAINED THEREIN.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, MUSTAJARATI ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY OF THE FOLLOWING:
A. ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS;
B. PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE PLATFORM;
C. ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN;
D. ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES;
E. ANY BUGS, VIRUSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY;
F. ANY ERRORS OR OMISSIONS IN ANY USER CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE;
G. USER MATERIALS OR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY THIRD PARTY.
THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
7. General Provisions:
7.1 Governing Law:
